1. Acceptance of Terms

By downloading, accessing, or using SnapScale (“the App”), you agree to be bound by these Terms of Use and all applicable laws. If you do not agree, please do not use the App.

2. Overview of the Service

SnapScale allows users to capture and log their weight measurements using their iPhone camera and optionally analyze data from Apple Health. The App provides both free features and premium features available through a subscription.

Premium features may include enhanced insights such as trend analysis, sleep-weight correlations, and other analytical tools. The specific features available under each plan may change over time.

3. Subscriptions and Payments

• Payment will be charged to your Apple ID account upon confirmation of purchase.
• Subscription options include monthly and yearly auto-renewable plans, as shown in the App.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription in your App Store account settings after purchase.
• Refunds are handled by Apple. Please contact Apple Support for refund requests.
• Prices for subscriptions are displayed in your local currency within the App Store and may vary by region due to currency exchange or tax differences.
• SnapScale reserves the right to modify subscription pricing or available features for future billing periods. Any changes will not affect the current active subscription term.

4. User Data and Privacy

All image, weight, and health data processed by SnapScale remains on your device. SnapScale does not collect, store, or transmit any personal data externally. Any data read from Apple Health is used only within the app and never shared or uploaded.

5. User Responsibilities

You agree to use SnapScale only for lawful purposes and in compliance with all applicable laws. You may not attempt to interfere with, reverse engineer, or misuse the App or its functionality.

6. No Medical Advice

SnapScale is intended for general wellness and informational purposes only. It is not a medical device and should not be used for diagnosis, treatment, or medical decision-making.

7. Intellectual Property

All rights in SnapScale are owned by Fitmarket Life d.o.o. You may not reproduce, distribute, or modify any part of the App without written consent.

8. Limitation of Liability

SnapScale is provided “as is” without warranties of any kind. Fitmarket Life d.o.o. is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the App.

9. Third-Party Beneficiary

Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Croatia.

11. Modifications

We may update these Terms periodically. Continued use of the App after updates means acceptance of the new Terms. The current version will always be available at https://snapscale.life/terms_of_use.html.

12. Apple EULA

By using SnapScale, you also agree to Apple’s Licensed Application End User License Agreement (EULA). These Terms supplement, and do not replace, Apple’s EULA.
